Mesothelioma
caused by exposure to asbestos causes the deaths of thousands
of people each year. Approximately 75% of all mesothelioma
cases are directly linked to prolonged contact with asbestos,
so it's not surprising that many people feel obligated to seek
legal recourse against the manufacturers of this harmful
substance. While you may not have been able to prevent your
current medical condition, you do still have legal rights. By
hiring a lawyer with knowledge and experience with asbestos
torts, you'll have a much better chance of receiving
compensation from those responsible for your
illness.
There are some similarities in the legal
situation between cigarette and asbestos manufacturers. Perhaps
the most telling (and damaging) is the fact that both of those
industries knew of the dangers of the products they were
producing, but didn't tell employees or the general public. By
the 1920's, asbestos companies knew that exposure caused
significant damage to the human body, sometimes even resulting
in death.
The actions of the asbestos industry are
considered to be criminal, which means that you can seek
compensation through the legal system. You have the opportunity
to not only receive monetary compensation, but also to see the
guilty party pay for their actions. There are a number of
expenses that may be covered, including lost wages, medical and
hospital bills, and travel expenses. There is also the chance
of receiving money for pain and suffering.
There are two kinds of lawsuits you can file in
absestos cases. The first is a wrongful death suit. This is
filed when a family member has passed away from mesothelioma.
The second is a personal injury claim, in which the person
suffering from the asbestos-related injury has to file.
Asbestos victims (and their families) have the right to sue
after the initial diagnosis, regardless of how many years have
passed since the first exposure. It's important to note,
however, that there is a statute of limitations that takes
effect after the initial diagnosis, so if you wait too long,
you won't be able to file a claim.
If you've been exposed to asbestos and have
developed a potentially fatal illness, you have every right to
try to claim some kind of financial restitution from the
company responsible for causing your mesothelioma. Even besides
the money, it will ease your mind that those who hold
responsibility for inflicting suffering on you will have to
deal with some of their own.
